Welcome to ALCOM COMPUTERS. These Terms & Conditions (“Terms”) govern your use of this website and your purchase of any product or service from M/S ALCOM COMPUTERS, Darul Aman Market, Jamalpur, Aligarh, Uttar Pradesh 202001, India (“ALCOM”, “we”, “us” or “our”). By using this website, creating an account, placing an order or paying an invoice, you (“you” or “the customer”) agree to these Terms. If you do not agree, please do not use our website or services.
1. About us
ALCOM COMPUTERS is a small business dealing in computer and IT products, hardware goods, domain name registration, website hosting and related IT services. We are registered with the Department of Commercial Taxes, Government of Uttar Pradesh, since 15 June 2011.
2. Eligibility and accounts
- You must be at least 18 years old, or use our services with the involvement of a parent or guardian, and be legally able to enter into a contract under Indian law.
- The information you give us (name, email, phone, address, business details) must be true, complete and kept up to date.
- You are responsible for keeping your login details confidential and for all activity under your account. Tell us at once if you suspect unauthorised use.
- We may suspend or close accounts that give false information, misuse the website, or breach these Terms.
3. Products, services and prices
- All products and services are subject to availability. Descriptions, images and specifications are for general information and may change without notice.
- Prices shown on this website or quoted to you are in Indian Rupees (INR) unless stated otherwise and may change without notice. Applicable taxes (including GST where applicable), shipping and third-party charges are extra unless clearly included.
- If a price or description is shown in error, we may cancel the order and refund any amount paid for it.
- A quotation is valid only for the period stated on it, or 7 days if no period is stated.
4. Orders and payment
- Orders may be placed through this website, through our partner order portals, in our shop, by phone, WhatsApp or email.
- An order is accepted only when we confirm it. We may refuse or cancel any order at our discretion, for example where stock is unavailable or payment cannot be verified.
- Payment must be received in full before goods are dispatched or services are activated or renewed, unless we agree otherwise in writing.
- We accept UPI (including Paytm), bank transfer, cash at our shop and other methods shown at checkout. Payments made by UPI or bank transfer are confirmed manually and may take up to one working day to reflect.
- You are responsible for paying invoices and renewals on time. Overdue services may be suspended without further notice.
5. Domain name registration
- Domain names are registered through accredited registrars and are governed by the rules of ICANN, the relevant registry (for example NIXI for .in domains) and the registrar's own agreements, which form part of these Terms.
- A domain is not yours until registration is confirmed by the registry. Showing a domain as “available” is not a guarantee that it will be registered.
- You must give accurate registrant (WHOIS) details. Incorrect details can lead to suspension or loss of the domain under registry rules.
- Renewal is your responsibility. We try to send reminders, but we are not liable if a domain expires because a renewal was not paid in time. Recovering an expired domain may cost extra and is not always possible.
- Registrations, renewals and transfers cannot be cancelled or refunded once submitted to the registry.
- You must not register a domain that infringes anyone's trademark or other rights. Domain disputes are handled under the UDRP or INDRP as applicable.
6. Website hosting, email and backup services
- Hosting, email, backup (including BackMeUp) and similar services are provided according to the plan you select, which sets the resources, features and limits.
- We aim for high availability but do not guarantee uninterrupted or error-free service. Planned maintenance, network issues or events outside our control may cause downtime.
- You are responsible for the content you host and the email you send, and for keeping your own copies of your data. Unless you have bought a backup service, any backups we keep are for our own disaster recovery and are not guaranteed to be available to you.
- Where you have bought a backup service, backups run on the schedule and retention period of that plan. Restores depend on a backup existing for the date you need.
- Fair usage applies. Accounts that use excessive resources or harm other customers may be limited, moved or suspended.
7. Acceptable use
You must not use our website or services to:
- break any law in force in India, including the Information Technology Act, 2000 and its rules;
- host or send spam, phishing, malware, or material that is obscene, defamatory, hateful or infringes intellectual property;
- attack, scan, overload or try to gain unauthorised access to any system or network;
- run open proxies, cryptocurrency mining, illegal file sharing or anything that harms the service for others.
We may suspend or terminate services without refund for breach of this section and may report illegal activity to the authorities.
8. Website design, web studio and IT services
- The scope, price and timeline of design or development work are as agreed in our quotation or in writing.
- You must supply content, images, logos and approvals on time. Delays on your side may extend delivery dates.
- You confirm that you own or have permission to use all material you give us.
- Ownership of the finished website passes to you once all invoices are paid in full. We may show the work in our portfolio unless you ask us not to.
- Changes requested after approval, or outside the agreed scope, may be charged extra.
- Alcom Web Studio and other online tools are provided on an “as available” basis under their own plan terms.
9. Computer hardware and IT products
- Warranty on hardware and software is provided by the manufacturer or publisher on their terms. We will help you raise warranty claims where possible.
- Warranty does not cover physical damage, liquid damage, power surges, unauthorised repair or misuse.
- For repairs, you are responsible for backing up your data before handing in a device. We are not responsible for loss of data during repair.
- Devices left with us for more than 60 days after we notify you that they are ready may be disposed of to recover costs, after a written reminder.
10. Third-party services
Some services, including domain registration, hosting infrastructure, business email, payment gateways and BackMeUp backups, are supplied with the help of third-party providers. Their terms also apply, and we are not responsible for their acts or failures beyond our reasonable control. Links to third-party websites are for convenience only.
11. Cancellation and refunds
Cancellations and refunds are covered by our Cancellation & Refund Policy, and delivery of goods by our Shipping Policy. Both form part of these Terms.
12. Intellectual property
The ALCOM COMPUTERS name, logo and the content of this website belong to us or our licensors. You may not copy or reuse them without our written permission, except to view and print pages for your personal use.
13. Limitation of liability
- To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss, including loss of profit, business, data or goodwill.
- Our total liability for any claim relating to a product or service is limited to the amount you paid us for that product or service in the 12 months before the claim.
- Nothing in these Terms limits any liability that cannot be limited under Indian law.
14. Indemnity
You agree to compensate us for any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of our services.
15. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, such as natural disasters, epidemics, government action, war, strikes, power or internet failures, or failures of upstream providers.
16. Suspension and termination
You may stop using our services at any time, subject to the Cancellation & Refund Policy. We may suspend or end services for non-payment, breach of these Terms, or where required by law or a registry. Sections that by their nature should survive termination will continue to apply.
17. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continuing to use our website or services after a change means you accept the updated Terms.
18. Governing law and disputes
These Terms are governed by the laws of India. We encourage you to contact us first so we can try to resolve any concern informally. Any dispute that cannot be resolved will be subject to the exclusive jurisdiction of the courts at Aligarh, Uttar Pradesh.
